第一章总 则

Chapter One: General Rules

第一条为建立和维护正常的教学、科研和生活秩序，优化育人环境，培养高素质的合格人才，根据《中华人民共和国高等教育法》《普通高等学校学生管理规定》《高等学校学生行为准则》等有关法律、规章和《东北林业大学章程》规定，结合学校实际，特制定本条例。

Article 1: The provisions are formulated in accordance with Higher Education Law of the People’s Republic of China, Regulations on the Administration of Students in Regular Higher Education Institutions, Code of Conduct for College Students, Regulations of NEFU and the current situations at NEFU to keep the normal order of teaching, scientific research and daily life, optimize the educational environment and improve the quality of training talents.

第二条本条例适用于具有东北林业大学学籍的外国留学生、已经入学报到尚处在学籍审查期的新生。

Article 2: International students who have registered at NEFU and new students who have been admitted but in the review period should follow the regulations.

第三条留学生在华学习期间，有义务遵守中国的宪法、法律法规和学校的各项规章制度，依法接受学校的管理，如有违法、违规、违纪行为，学校将视其情节轻重，给予批评教育或相应的纪律处分，触犯刑法的，移送司法部门处理。

Article 3: During the international students’ study in China, they must abide by Chinese Constitution, Chinese laws as well as the rules and regulations in China and at NEFU. Those who violate the laws, regulations or disciplines will be punished based on the seriousness of the cases. Those who violate the criminal laws will be punished by the judicial departments.

第二章纪律处分的种类与适用

Chapter Two: Classification and Application of Disciplinary Actions

第四条纪律处分的种类包括：

Article 4: Disciplinary Actions Include:

（一）警告；

(I) Warning;

（二）严重警告；

(II) Serious Warning;

（三）记过；

(III) Demerit Record;

（四）留校察看；

(IV) Disciplinary Probation (be kept in school but placed under surveillance)

（五）开除学籍。

(V) Expulsion

第五条有下列情形之一，可从轻处理：

Article 5: International students in the following cases may be punished leniently:

（一）违纪后，主动承认错误，并及时采取补救措施者；

(I) Admit the mistakes voluntarily and take remedial measures promptly after violation;

（二）受他人胁迫或诱骗，但能主动举报，认错态度好；

(II) Report and admit their mistakes voluntarily after being forced or tricked by others;

（三）积极协助学校查处违纪事件有立功表现者；

(III) Actively assist the university in investigation after violation;

（四）其他可从轻处理的情形。

(IV) In other cases, international students can be punished leniently.

第六条有下列情形之一者，可从重或加重处理：

Article 6: International students may be punished severely in the following cases:

（一）违纪后，态度极差、拒不接受教育或屡教不改者；

(I) Reject to admit or correcting their mistakes and violate the rules repeatedly;

（二）故意隐瞒、歪曲、捏造事实，妨碍有关部门调查取证者；

(II) Deliberately conceal, distort or fabricate stories or hinder the investigation and evidence collection;

（三）对违纪行为的检举人、证人或对处理违纪行为的工作人员进行威胁、侮辱、诽谤、诬陷、恐吓，或打击报复者；

(III) Threaten, insult, slander, frame, intimidate, or retaliate the prosecutor, witnesses or the staffs who investigate the prohibited behaviors;

（四）屡次不改者、重犯或同时有两种以上（含两种）违纪行为者；

(IV) Reject to correcting their mistakes, violated the rules repeatedly or having two (including two) kinds of behavior which violate the rules;

（五）策划或组织违纪者；

(V) Plan or organize the prohibited behaviors;

（六）违纪行为影响恶劣或严重破坏学校声誉者；

(VI) Bring baneful influence or bad reputation to the university;

（七）破坏、损毁、污损公私财物，盗窃、诈骗、冒领公私财物，抢劫、抢夺公私财物，非法占有埋藏物、遗留物，或伤害他人身体者，应及时退还非法占有财物，并对所造成的人身和财产损失进行赔偿，如不按规定赔偿或退还者，加重一级处分；

(VII) Those who destroy, damage and deface public or private property; steal, defraud, falsely claim for public or private property; rob and loot public or private property; illegally possess the hidden property or hurt others shall return the illegal possessions and compensate for the caused injury and property loss; Otherwise, the punishment shall be aggravated;

（八）其他应予从重处理的情形。

(VIII) In other cases, international students can be punished severely.

第三章违纪行为及处分

Chapter There: Disciplinary Actions and Punishment

第七条违反中国法律、扰乱社会秩序、危害中国国家安全与统一的，给予以下处分：

Article 7: Those who violate Chinese laws, disrupt social order, endanger the national security and the unity of China shall be punished as follows:

（一）对煽动、策划、组织非法集会、游行、示威、罢课等行为者给予开除学籍处分；对参与者，视情节轻重，给予留校察看或开除学籍处分；

(I) Those who incite, plan and organize the unlawful assembly, procession, demonstration and classroom boycott shall be expelled.The participants will be placed under surveillance or expelled according to the seriousness of their behaviors.

（二）公开发表危害中国国家安全与统一的文章、演说、宣言、声明，经教育仍坚持不改者，给予开除学籍处分；

(II) Those who publicly publish articles, speeches, declarations and statements that endanger the national security and unity of China and reject to correct their mistakes shall be expelled.

（三）煽动民族仇恨、民族歧视，或非法制作、复制、书写、印刷、张贴、散发有损安定团结的标语、传单、大小字报、图片等信息者，视情节轻重，给予留校察看或开除学籍处分；

(III) Those who incite ethnic hatred or discrimination, or illegally prepare, copy, write, print, paste or distribute slogans, leaflets, posters, pictures and other information that threaten the social stability shall be placed under surveillance or expelled according to the seriousness of their behaviors.

（四）制造和故意散布谣言煽动他人，制造混乱，视情节轻重，给予严重警告直至开除学籍处分。

(Ⅳ) Those who fabricate and deliberately spread rumors to incite others and make a mess shall be seriously warned and even expelled according to the seriousness of their behaviors.

第八条组织、参加非法组织和活动的，给予以下处分：

Article 8: Those who organize or participate in the illegal organization and activity shall be punished as follows:

（一）组织、成立、加入非法社会团体、组织，从事非法活动，出版非法刊物者，或利用某种活动或组织发展、控制成员，危害学校及社会正常秩序者，给予留校察看处分；情节严重的，给予开除学籍处分；

(I) Those who organize, establish or take part in social illegal organizations, take illegal activities, publish illegal magazines, or make use of some activities or organizational to control members and endanger the normal order of the school and the society shall be placed under surveillance. Those who have worse behaviors shall be expelled from NEFU.

（二）违反学校社团管理的有关规定，未经批准组织成立学生社团并开展活动，出版刊物并造成不良影响的，给予记过直至开除学籍处分；以合法学生社团的名义开展非法活动，损害学校声誉，造成不良影响的，给予留校察看或开除学籍处分；

(II) Those who violate relevant provisions of managing associations, organize and set up students’ associations without approval, publish illegal magazines and cause adverse effects shall be recorded a demerit and even be expelled from NEFU. Those who set up the legal student organizations for unlawful activities, damage the reputation of the university and cause adverse effects shall be placed under surveillance or expelled.

（三）组织、教唆、胁迫、诱骗、煽动他人从事各种反动、邪教、会道门活动或有参与、利用邪教、会道门、迷信活动扰乱社会秩序、损害他人身体健康的，给予留校察看处分，情节严重的，给予开除学籍处分；

(III) Those who organize, instigate, force, trick and incite others to engage in all kinds of reactionary cults, superstitious sects and secret societies; take part in or make use of those to disrupt social order and damage the health of others shall be placed under surveillance. Those who have worse behaviors shall be expelled.

（四）在学校组织或参加宗教活动，不听劝阻者，给予严重警告或记过处分；造成严重不良影响的，给予留校察看或开除学籍处分；

(IV) Those who organize or participate in religious activities in schools and don’t follow teachers’ suggestions to stop shall be seriously warned or recorded a demerit. Those who cause serious adverse effects shall be placed under surveillance or expelled.

（五）未经审批擅自组织募捐、收取活动经费、协会会费的，给予警告或严重警告处分；造成不良后果的，给予记过或留校察看处分。

(V) Those who organize donations or collecting funds without approval shall be warned or seriously warned. Those who cause adverse consequences shall be recorded a demerit or placed under surveillance.

第九条触犯中国法律，构成犯罪，应依法追究刑事责任的，给予开除学籍处分。

Article 9: Those who violate Chinese laws to commit crimes and get criminal sanctions shall be expelled.

第十条违反中国法律、法规，受到治安管理处罚的，给予以下处分：

Article 10: Those who violate Chinese laws and regulations and get public security punishment shall be punished as follows:

（一）被处以警告处罚的，给予警告处分；

(I) Those who are warned by public security departments shall be warned by the university;

（二）被处以罚款处罚的，视其情节给予警告或者严重警告处分；

(II) Those who are fined shall be warned or seriously warned based on the seriousness of their behaviors;

（三）被处以拘留5天及以下处罚的，视其情节给予记过处分；

(III) Those who are in custody for 5 days and below shall be recorded a demerit according to the seriousness of their behaviors;

（四）被处以拘留6至10天处罚的，给予留校察看处分；

(IV) Those who are in custody for 6 to 10 days shall be placed under surveillance at NEFU;

（五）被处以拘留11天及以上处罚的，给予开除学籍处分。

(V) Those who are in custody for 11 days and more shall be expelled.

第十一条留学生在校期间，以任何形式参与赌博或变相赌博的，给予以下处分：

Article 11: Those who participate in gambling of any kind in school shall be punished as follows:

（一）提供赌博场所、赌资或赌具者，视情节轻重，给予警告、严重警告或记过处分；

(I) Those who provide gambling sites, gambling funds or tools shall be warned or seriously warned according to the seriousness of their behaviors;

（二）观看赌博者给予警告处分；

(II) Gambling spectators shall be warned;

（三）组织赌博者给予记过或留校察看处分，一般参与者给予严重警告或记过处分，情节特别严重，影响恶劣者，给予开除学籍处分；

(III) Gambling organizers shall be recorded a demerit or placed under surveillance at NEFU, and the general participants shall be seriously warned or recorded a demerit. Those have worse behaviors and cause bad influences shall be expelled;

（四）多次参与赌博屡教不改者，给予开除学籍处分；

(IV) Gambling repeaters who reject to correct their mistakes shall be expelled;

（五）因赌博引起打架、斗殴或造成其他不良后果者，可加重处分。

(V) Those who fight due gamble and cause other adverse consequences may be punished severely.

第十二条对其他个人、组织进行侮辱、诽谤或滋扰者，视情节轻重，给予警告直至留校察看处分；经教育仍坚持不改者给予开除学籍处分。

Article 12: Those who insult, slander or interfere others shall be warned and even placed under surveillance at NEFU. Those who still reject to correct their mistakes shall be expelled

第十三条有侵犯他人隐私等人身权利，未受公安、司法部门处罚者，视情节轻重给予严重警告、记过或留校察看处分；经教育仍坚持不改者，给予开除学籍处分。

Article 13: Those who infringe others’ privacy and personal rights but are not punished by Public Security Departments and Judicial Departments shall be seriously warned, recorded a demerit or placed under surveillance at NEFU according to the seriousness of their behaviors. Those who still reject to correct their mistakes shall be expelled.

第十四条从事或参与有损留学生形象、有违中国社会公德活动者，给予以下处分：

Article 14: Those who engage in or participating in activities which have had influences on he image of the international students and transgress social morality in China shall be punished as follows:

（一）观看黄色、淫秽音像制品、书刊、网页者，给予警告直至留校察看处分；

(I) Those who watch pornographic audio-visual products, read pornographic books and browse pornographic websites shall be warned and even placed under surveillance at NEFU;

（二）制作、复制、贩卖、传播淫秽书刊、影片、音像、图片或其他淫秽物品、禁读作品者，视情节轻重，给予留校察看或开除学籍处分；

(II) Those who prepare, copy, sell and spread pornographic books, films, videos, pictures or other pornographic and prohibited articles shall be placed under surveillance at NEFU or expelled according to seriousness of their behaviors;

（三）在校园公共场所，行为不得体、不文明，经教育不改，或造成恶劣影响者，给予警告直至留校察看处分；

(III) Those who have improper behaviors in public places on campus, reject to correct their mistakes and cause bad influence shall be warned and even placed under surveillance at NEFU;

（四）有骚扰、调戏、侮辱妇女或其他流氓行为者，给予记过直至开除学籍处分；

(IV) Those who harass, molest or insult women or have other rogue actions shall be recorded a demerit and even expelled;

（五）非法同居或同宿者，或在异性集体宿舍留宿者，给予记过直至开除学籍处分；

(V) Those who live together illegally or live in the dorm of opposite sex shall be recorded a demerit and even expelled；

（六）介绍或参与“三陪”（在酒吧、歌舞厅等娱乐场所陪异性客人吃喝玩乐等）活动，视情节轻重，给予留校察看或开除学籍处分；

(VI) Introducer or participants of “illegal sexual services” (entertainment with heterosexual guests in bars, dance halls and other entertainment venues to seek pleasure) shall be placed under surveillance at NEFU or expelled according to seriousness of their behaviors;

（七）嫖娼、卖淫或介绍、收容嫖娼、卖淫者，给予开除学籍处分；

(VII) Those who are involved in prostitution, go whoring, introduce or accept the whoremaster or prostitutes shall be expelled;

（八）破坏他人婚姻、家庭或以恋爱为名玩弄异性者，给予开除学籍处分。

(VIII) Those who damage other people's marriage or family, or play with the opposite sex in the name of love shall be expelled.

第十五条打架斗殴者，给予以下处分：

Article 15: Fighting-involvers shall be punished as follows:

（一）挑起事端者：

(I) Troublemaker:

1．虽未动手打人，但造成打架后果者，视情节给予警告、严重警告、记过或留校察看处分；

1. Those who do not beat others but cause the fight shall be warned, seriously warned, recorded a demerit or placed under surveillance at NEFU according to their behaviors;

2．动手打人未致伤者，视情节给予记过或留校察看处分；

2. Fighters who do not hurt others shall be recorded a demerit or placed under surveillance at NEFU according to the seriousness of their behaviors;

3．打人致他人受伤害者，视情节给予记过直至开除学籍处分；

3. Those who beat and hurt others shall be recorded a demerit and even expelled according to the seriousness of their behaviors;

4．对证人报复、威胁或殴打者，视情节轻重，给予留校察看或开除学籍处分；

4. Those who revenge, threaten or beat the witness shall be placed under surveillance at NEFU or even expelled according to the seriousness of their behaviors;

5．因教师或工作人员批评而动手打人者，给予留校察看或开除学籍处分；

5. Those who attack the teachers or staffs shall be placed under surveillance at NEFU or even expelled;

6．聚众斗殴为首者、组织策划打架者，视情节轻重，给予留校察看或开除学籍处分。

6. Leader of affray and planner of a fight shall be placed under surveillance at NEFU or even expelled according to the seriousness of their behaviors.

（二）打架者：

(II) Fighting-involvers:

1．打人未致伤者，给予警告或严重警告处分；

1. Those who fight others but do not cause injurery shall be warned or seriously warned;

2．致他人伤害者，视情节给予记过直至开除学籍处分；

2. Those who hurt others shall be recorded a demerit and even expelled according to the seriousness of their behaviors;

3．聚众斗殴者，视情节轻重，给予留校察看或开除学籍处分。

3. Those involved in affray shall be placed under surveillance at NEFU or even expelled according to the seriousness of their behaviors.

（三）参与者：

(III) Participants:

对以“劝架”为名，偏袒一方，促使殴打事态发展并产生后果者，给予严重警告或记过处分。

Those who support one side in the name of “intermediation” to make things worse shall be seriously warned or recorded a demerit.

（四）伪证者：

(IV) Perjurer:

1．虽未参与打架但故意为他人作伪证，造成调查困难者，给予严重警告或记过处分；

1. Perjurers who are not involved in a fight but intentionally commit perjury for others to make trouble in investigation shall be seriously warned or recorded a demerit.

2．已判定为参与打架的伪证者，加重一级处分。

2. Perjurers who have been participated in the fight shall be punished severely.

（五）为他人打架提供器械者：

(V) Providers of the tools in fight:

1．未造成严重后果者，给予警告直至记过处分；

1. Those who do not cause serious consequences shall be warned and even recorded a demerit;

2．造成严重后果者，给予留校察看或开除学籍处分。

2. Those who cause serious consequences shall be placed under surveillance at NEFU or even expelled.

（六）在打架过程中，持械打人者，加重一级处分。

(VI) Those who use tools in a fight shall be punished severely.

第十六条违反学校规定，影响学校教育教学秩序、生活秩序以及公共管理秩序，侵害其他个人、组织合法权益者，给予以下处分：

Article 16: Those who violate provisions at NEFU, interrupt the education orders, living orders and public orders, infringe others’ legitimate rights and interests shall be punished as follows:

（一）在公寓、教室、图书馆等场所私拉电线或违章使用电器不听劝阻者，在公寓房间使用煤气炉、违章电器以及生火、燃烧物品者，视情节轻重，给予警告、严重警告或记过处分；造成火警、火灾事故者，给予留校察看或开除学籍处分；

(I) Those who lay wires in the apartments, classrooms, libraries and other places without permission, illegally use the electrical appliances regardless, use gas stove or electrical appliance improperly, make a fire or burn things shall be warned, seriously warned or recorded a demerit according to the seriousness of their behaviors.Those give rise to fire alarm and cause fire accident shall be placed under surveillance at NEFU or expelled;

（二）故意损毁、擅自挪用消防设施或各种安全、指示标志者，堵塞消防通道、无火情下触发报警装置、谎报火情者，阻碍消防车辆、人员通行者，扰乱火灾现场秩序者，在重点防火单位或场所擅自使用明火者，给予记过处分；情节严重的，给予留校察看处分；造成严重后果的，给予开除学籍处分；

(II) Those who intentionally damage or embezzle various fire fighting devices and indication signs without permission, block fire fighting access, trigger fire alarm without any fire to give false information and those who hinder fire fighting vehicle and access, cause disorders in fire scene and those who use open fire in key fire prevention places shall be recorded a demerit. Those who have worse behaviors shall be placed under surveillance at NEFU. Those who lead to serious consequences shall be expelled;

（三）将枪支、弹药、管制刀具或者易燃、易爆、剧毒、放射性、腐蚀性物质或传染病病原体等危险品擅自带入学校或者带出实验室、仓库等规定保管场所，造成严重公共安全隐患者，给予记过处分；情节严重的，给予留校察看处分；造成人身财产损失的，给予开除学籍处分；

(III) Those who carry guns, ammunition, knives, or flammable, explosive, toxic, radioactive, corrosive substances or infectious pathogens and other dangerous goods into school or out of laboratory, warehouse and other stated storage places without authorization to seriously endanger public security shall be recorded a demerit. Those who have worse behaviors shall be placed under surveillance at NEFU. Those who who cause personal injury and property loss shall be expelled;

（四）故意破坏学校公共财物者，视情节轻重，给予严重警告直至开除学籍处分，并对破坏物品进行相应赔偿；

(IV) Those who intentionally destroy the public property at NEFU shall be seriously warned or expelled according to the seriousness of their behaviors and shall compensate for the loss.

（五）未经批准，在教学楼、公寓或公共场所哄闹或者举行娱乐活动，妨碍他人工作、学习和休息，且不听劝阻者，给予严重警告处分；情节严重的，给予记过直至留校察看处分；

(V) Those who horse around or do entertainment in the teaching building, apartment or public places; hinder others in work, study and rest shall be seriously warned.Those who have worse behaviors shall be recorded a demerit and even placed under surveillance at NEFU;

（六）严重扰乱课堂、实验室等场所教学秩序或者食堂、公寓等生活场所秩序，且不听劝阻者，给予严重警告处分；情节严重的，给予记过直至开除学籍处分；

(VI) Those who seriously interrupt the orders in classroom, laboratory, canteens, apartments and other places shall be seriously warned. Those who have worse behaviors shall be recorded a demerit and even expelled;

（七）凡在学校公共场所或公寓、寝室等酗酒者给予严重警告处分，酒后滋事者给予记过直至开除学籍处分；

(VII) Intemperants in public places such as apartment or dormitories shall be seriously warned and drunken troublemakers shall be recorded a demerit and even expelled;

（八）有高空抛物、公共场所乱涂乱画、乱丢垃圾的，在公寓、教室、图书馆或其他禁止吸烟的地方吸烟，不听劝阻者，给予警告或严重警告处分；

(VIII) Those who have high toss acts, scrawl or litter in public place and those who smoke in apartments, classrooms, libraries or other places shall be warned or seriously warned;

（九）将宠物带入教室、办公室、实验室、公寓等场所，不听劝阻者，给予警告或严重警告处分；

(IX) Those who bring pets into classrooms, offices, laboratory, apartments and other places shall be warned or seriously warned;

（十）利用其他形式扰乱学校秩序的，给予警告或严重警告处分；情节严重的，给予记过直至开除学籍处分。

(X) Those who interrupt the normal orders at NEFU shall be warned or seriously warned.Those who have worse behaviors shall be recorded a demerit and even expelled.

第十七条违反学校留学生公寓管理相关规定者，给予以下处分：

Article 17: Those who violate relevant apartment management rules shall be punished as follows:

（一）未经批准，在公寓进行推销等商业活动，经教育不改者，给予警告直至留校察看处分；

(I) Those who make commercial activity (such as marketing) at the students apartment without approval and do not stop after being exhorted shall be warned or placed under surveillance at NEFU;

（二）不按规定时间归寝，不听劝告、不服管理者，给予警告直至记过处分；晚归爬墙爬窗进入留学生公寓，给予严重警告或记过处分；

（三）(II) Those who do not return to heir apartments before the specified time and those who do not obey the rules shall be warned or recorded a demerit. Those who come back late and enter into international students’ apartment by crossing the fence and window shall be warned seriously or recorded a demerit;

（四）未经允许擅闯留学生公寓，不听劝阻者，给予警告或严重警告处分；

(III) Those who enter into international students’ apartment without approval shall be warned or warned seriously;

（五）已登记为校内住宿却擅自离校住宿者，给予警告或严重警告处分，坚持不改者，给予记过或留校察看处分；

(IV) Those who have registered for accommodation within campus but live outside the university without approval shall be warned or warned seriously; and those who violate the rules repeatedly shall be recorded a demerit or placed under surveillance at NEFU;

（六）在公寓房间内利用电脑、音响等设备干扰他人学习、生活者视情节和认识态度给予警告或记过处分；

(V) Those who disturb others’ learning and living by using computer and sound equipment etc. in apartment rooms shall be warned or recorded a demerit according to their behaviors and attitudes;

（七）在公寓内大声喧哗、打闹、拍球、大声播放音响严重影响他人休息、学习者，视情节轻重给予警告直至记过处分；

(VI) Those who affect others’ rest and learning by making loud noise, quarreling and fighting noisily, tapping the ball, and playing the sound loudly within apartment shall be warned or recorded a demerit according to the seriousness of their behaviors;

（八）未经请假擅自夜不归宿者，视情节给予严重警告或记过处分；

(VII) Those who do not ask for leave and do not return to the apartment during nighttime shall be warned seriously or recorded a demerit according to their behaviors;

（九）拖欠公寓住宿费，多次催缴无效者，给予警告或严重警告处分；

(VIII) Those who do not pay their accommodation fees after being reminded several times shall be warned or warned seriously;

（十）对拒绝、阻碍学校管理人员依法或依校规执行安全检查等公务者，给予警告或严重警告处分，情节严重的，给予记过直至留校察看处分。

(IX) Those who refuse or hinder teachers to implement official activities (such as safety check etc.) shall be warned or warned seriously. Those who have worse behaviors shall be recorded a demerit or placed under surveillance at NEFU.

第十八条违反教育部《高等学校学生行为准则》，对待教师、同学和工作人员态度恶劣者，视情节和认识态度给予警告、严重警告或记过处分。

Article 18: Those who violate Code of Conduct for College Students and who treat teachers, students and work personnel with bad attitude shall be warned, warned seriously or recorded a demerit according to their behaviors and attitudes.

第十九条隐匿、毁弃、非法占有、私拆或以其他方式非法处理他人邮件的，给予警告直至留校察看处分。

Article 19: Those who conceal, scrap, occupyillegally, open others’ mails without permission or dispose of others’ mails shall be warned or placed under surveillance at NEFU.

第二十条将他人遗忘物、保管物或埋藏物非法据为己有者，视情节轻重，给予警告直至留校察看处分，构成犯罪的，给予开除学籍处分。

Article 20: Those who occupy forgotten property, stored objects or buried objects illegally shall be warned or placed under surveillance at NEFU according to the seriousness of their behaviors. Those who commit a crime shall be expelled.

第二十一条走私、贩私者，视情节轻重，给予警告直至留校察看处分，构成犯罪的，给予开除学籍处分。

Article 21: Those who smuggle or traffic in smuggle goods shall be warned or placed under surveillance at NEFU according to the seriousness of their behaviors. Those who commit a crime shall be expelled.

第二十二条种植、制造、运输、买卖、吸食、注射毒品，或引诱、教唆、容留他人吸食、注射毒品者，给予开除学籍处分。

Article 22: Those who plant, make, transport, purchase, sell, suck and inject narcotics or entice, instigate and accommodate others to suck and inject narcotics shall be expelled.

第二十三条伪造证明、涂改或伪造证件等弄虚作假行为者，视情节给予严重警告直至开除学籍处分。

Article 23: Those who fabricate certificates or obliterate any certificate shall be warned seriously or expelled according to the seriousness of their behaviors.

第二十四条投放有毒、有害物质，或以其他方式蓄意伤害他人身体者，视情节轻重，给予留校察看或开除学籍处分。

Article 24: Those who deliberately harm others by pouring toxic or hazardous substance or in other ways shall be placed under surveillance at NEFU or expelled according to the seriousness of their behaviors.

第二十五条盗窃、诈骗、抢夺、侵占、敲诈勒索公私财物者，除追回赃款、赃物或赔偿损失外，给予以下处分：

Article 25: Those who steal, defraud, snatch, occupy or racketeer public and private properties shall be punished in the following ways in case that the money or things has been taken back:

（一）案值（含共同作案,下同）人民币100元以下的，给予警告或严重警告处分；

(I) If the value of the property (including common crime-committing, similarly hereinafter) is lower than 100 RMB, the stealer shall be warned or warned seriously;

（二）案值人民币100－500元的，给予记过或留校察看处分；

(II) If the value of the property is between 100 RMB-500 RMB, the stealer shall be recorded a demerit or placed under surveillance at NEFU;

（三）案值人民币500元以上的，给予开除学籍处分；

(III) If the value of the property is larger than 500 RMB, the stealer shall be expelled;

（四）经公安机关或学校保卫处确认为撬锁，撬门窗进行盗窃的，从重处罚；

(IV) Those who have picked a lock or picked door and window for theft after confirmation by public security organization or security departments at NEFU shall be punished seriously;

（五）未窃得财物的，给予严重警告或记过处分。

(V) Those who fail to gain property in the theft shall be warned seriously or recorded a demerit.

第二十六条明知是赃款、赃物而参与分赃或予以窝藏、转移、购买、销售者，视情节轻重，给予警告直至留校察看处分；构成犯罪的，给予开除学籍处分。

Article 26: Those who participate in sheltering, transfering , purchasing or selling it while knowing that it is stolen money or stolen goods shall be warned or placed under surveillance at NEFU according to the seriousness of their behaviors. Those who committed a crime will be expelled.

第二十七条故意为他人作伪证，或帮助违法违纪者毁灭证据，给调查制造困难，造成一定后果者，给予严重警告或记过处分；后果严重者，给予留校察看或开除学籍处分。

Article 27: Those who give false testimony for others on purpose, help those violating laws and regulations to destroy the evidence, make troubles for the investigation shall be warned seriously or recorded a demerit.Those who have worse behaviors shall be placed under surveillance at NEFU or expelled.

第二十八条扰乱网络、通讯管理秩序的，给予以下处分：

Article 28: Those who disturb the normal order of network and communication shall be punished as follows:

（一）未经允许，侵入他人或公共计算机网络或使用计算机信息网络资源者，视情节轻重，给予严重警告直至开除学籍处分；

(I) Those who access to others' or public computer networks or use computer information network resources without permission shall be warned seriously or even expelled according to the seriousness of their behaviors;

（二）蓄意更改、盗用公用或他人计算机网络信息资源、破坏计算机网络正常运行秩序者，视情节轻重，给予记过直至开除学籍处分；

(II) Those who deliberately change or embezzle public or others' computer network information resources or break normal operation order of computer network shall be recorded a demerit or expelled according to the seriousness of their behaviors;

（三）盗用或利用他人账号进行非法通讯，故意制作、传播计算机病毒等破坏性程序者，视情节轻重，给予留校察看或开除学籍处分；

(III) Those who make illegal communication by embezzling or utilizing others' account; deliberately make and spread destructive procedure (such as computer virus etc.) shall be placed under surveillance at NEFU or expelled according to the seriousness of their behaviors;

（四）利用计算机网络从事危害中国国家安全及违反校规校纪的活动，复制和传播有碍社会治安及违反社会公德的信息，视情节轻重，给予留校察看或开除学籍处分；

(IV) Those who use internet to endanger the national security of China, violate rules and regulations at NEFU and spread information that obstructs public security and violates social morality shall be placed under surveillance at NEFU or expelled according to the seriousness of their behaviors;

（五）其他违反中国政府和学校计算机网络管理规定行为者，视情节轻重，给予警告直至开除学籍处分。

(V) Those who violate rules and regulations about computer and internet at NEFU or in China shall be warned or expelled according to the seriousness of their behaviors.

第二十九条无故旷课的，给予以下处分：

Article 29: Those who are absent from the classes without legitimate reasons shall be punished in the following ways:

（一）对旷课和无故不参加教学计划规定的各项活动的留学生，指导教师要及时进行批评教育，并视情节轻重给予以下纪律处分：

(I) Supervisors should warn the international students who are absent from the classes and don’t take part in the activities without any legitimate reasons. The following punishment will be given according to the situation:

1．一学期内累计旷课24－32（均含本数，下同）学时，或在校内学习期间累计旷课33－48学时者，给予警告处分；

1. Those who have been absent for 24-32 (including the number, similarly hereinafter) credit hours accumulatively within one semester or for 33-48 credit hours accumulatively during his/her studying career at NEFU shall be warned;

2．一学期内累计旷课33－48学时，或在校内学习期间累计旷课49－64学时者，给予严重警告处分；

2. Those who have been absent for 33-48 credit hours accumulatively within one semester or for 49-64 credit hours accumulatively during his/her studying career at NEFU shall be warned seriously;

3．一学期内累计旷课49－64学时，或在校内学习期间累计旷课65－80学时者，给予记过处分；

3. Those who have been absent for 49-64 credit hours accumulatively within one semester or for 65-80 credit hours accumulatively during his/her studying career at NEFU shall be recorded for demerit;

4．一学期内累计旷课65－80学时，或在校内学习期间累计旷课81－112学时，给予留校察看处分；

4. Those who have been absent for 65-80 credit hours accumulatively within one semester or for 81-112 credit hours accumulatively during his/her studying career at NEFU shall be placed under surveillance in school;

5．一学期内累计旷课81－112学时，或在校内学习期间累计旷课113学时以上者，给予开除学籍处理。

5. Those who have been absent for 81-112 credit hours accumulatively within one semester or for more than 113 credit hours accumulatively during his/her studying period shall be expelled.

（二）旷课一天按8学时认定；无课期间未经批准擅自离校的，按旷课处理。

(II) Those who does not attend classes for a day will be recorded as being absent for 8 credit hours. When international students do not have courses, those who leave NEFU without any approval shall be considered as truancy.

（三）对于因旷课受到记过及以上处分的中国政府奖学金生，将取消其延长资助年限的申请资格。

(III) The qualification for the extension of studies will be canceled if the international students who enjoy CSC scholarship are recorded for demerit and receive severer punishment due to truancy.

第三十条违反考试纪律的，给予以下处分：

Article 30: Those who violate rules and regulations during exams shall be punished in the following ways:

（一）学生不遵守考场纪律，不服从考试工作人员的安排与要求，有下列行为之一者，可认定为考试违纪，该课程按零分计，视情节轻重及认识态度，给予严重警告、记过或留校察看处分：

(I) International students who disobey the rules and regulations during exams and don't follow the instructions by the exam staffs will be punished. The score of the course will be recorded as “0”. He/ she will be warned seriously, recorded for demerit, or placed under surveillance in school according to the seriousness of his/her behavior and his/her attitude:

1．携带规定以外的物品进入考场或未放在指定位置者；

1. Those who take exams with extra tools or do not place them at designated places;

2．未在规定的座位参加考试者；

2. Those who do not take the exams at specified seat;

3．在桌面上书写有与考试科目有关的字迹；

3. Those whose exams desks where there are words related with the exam subject;

4．考试开始信号发出前答题或者考试结束信号发出后继续答题；

4. Those who answer the questions before the starting of the exam or after the deadline of the exam;

5．开考后仍将考试必备用品以外的物品如书包、复习资料、手机、电子记事本、电子辞典等留在座位旁、桌内；

5. Those who keep forbidden materials or tools, such as schoolbag, review information, cellphone, electronic notebooks and electronic dictionaries and others near the seats or desks after the exam starts;

6．在考试过程中旁窥、交头接耳、互打暗号或手势；

6. Those who peep at others’ exams, whispering to each other, or send secret signals or gestures during the exam;

7．开卷考试中借用他人书籍、笔记、资料等物品；

7. Those who borrow others’ books, notes, data and other materials in open-book examination;

8．未经监考教师同意在考试过程中擅自离开考场；

8. Those who leave the examination room during exams without getting the approval from the teachers;

9．考试期间在考场内喧哗，干扰监考教师工作；

9. Those who make hubbub during the exam and disturb the work of teachers during the exams;

10．将试卷、答卷（含答题卡、答题纸）等考试用纸带出考场；

10. Those who take examination paper and answer sheet out of the examination room;

11．其他违反考场规则但尚未构成作弊的行为。

11. Other behaviors violating the rules and regulations during the exam but aren’t cheating。

（二）有下列行为之一者，按考试作弊论，该课程按零分计，并给予开除学籍处分：

(II) Those who have one of the following behaviors shall be considered as cheating during exams and shall be expelled. The score of the course shall be recorded as “0”.

1．找他人******************或替他人考试；

1. Those who ask for others to take examination for them or take examination in place of others;

2．组织作弊；

2. Those who organize cheating;

3．闭卷考试时，使用手机等电子设备搜索、浏览与考试内容有关的信息；

3. Those who use electronic equipment (such as cellphone etc.) to search and browse information related with examination in closed-book examination;

4．向他人出售考试试题或答案牟取利益；

4. Those who sell examination questions or answers to others for profits;

5．其他严重作弊或者扰乱考试秩序行为的。

5. Other serious behaviors of cheating or behaviors which disturb examination order.

（三）有下列行为之一者，按考试作弊论，该课程按零分计，并给予留校察看或开除学籍处分：

(III) Those who have one of the following behaviors shall be considered as cheating during exams and shall be placed under surveillance at NEFU or expelled. The score of the course shall be recorded as “0”.

1．闭卷考试时，桌内、座位旁有翻开的或答卷下面垫有与考试内容有关的书、笔记、讲义、复习资料等物品；

1. Those who keep open materials in closed-book examination, such as books, notes, teaching materials and others within the desk drawer, at adjacent area or under answer sheet;

2．闭卷考试时，携带与考试内容有关的文字材料或存储有关考试内容的电子设备等参加考试；

2. Those who carry written materials or electronic equipment with information related with the exam in closed-book examination;

3．抄袭或者协助他人抄袭试题答案或者与考试内容有关的资料；

3. Those who plagiarize or help others to plagiarize answers of the exam;

4．抢夺、窃取他人试卷、答卷（含答题卡、答题纸等）、草纸或者强迫他人为自己抄袭提供方便；

4. Those who snatch or filch others' examination paper, answer sheet or scratch paper or force others to provide convenience for their own plagiarism;

5．故意销毁试卷、答卷（含答题卡、答题纸等）及其他考试材料；

5. Those who destroy examination paper and answer sheet and other examination materials deliberately;

6．在答卷（含答题卡、答题纸等）上填写与本人身份不符的姓名等信息；

6. Those who fill in information (such as name etc.) that is not in accordance with their identity on answer sheet ;

7．传、接或者交换试卷、答卷（含答题卡、答题纸等）、草稿纸等；

7. Those who circulate, accept or exchange examination paper, answer sheet or scratch paper etc;

8．其他应认定为考试作弊的行为。

8. Other behaviors that shall be considered as cheating.

第三十一条有下列违反学术规范行为之一的，给予以下处分：

Article 31: Those who violate academic regulations shall be punished in the following ways:

（一）在课程作业、科学研究报告或者其他未正式发表的学术成果中，有剽窃、造假等违反学术规范行为的，视情节轻重，给予严重警告直至开除学籍处分；

(I) Those have behaviors violating the academic regulations such as plagiarism or forging in homework, scientific research or other unpublished papers shall be warned seriously or expelled according to the seriousness of their behaviors.

（二）在撰写毕业论文（设计）或学位论文过程中，有剽窃、造假等违反学术规范行为的，视情节轻重，给予记过直至开除学籍处分；

(II) Those have behaviors violating the academic regulations such as plagiarism or forging in writing thesis shall be recorded a demerit or expelled according to the seriousness of their behaviors.

（三）在校学习期间发表的学术论文、专著，主编、参编书籍中有剽窃、造假等行为的，视情节轻重，给予留校察看或开除学籍处分。

(III) Those have behaviors violating the academic regulations such as plagiarism or forging in academic papers and books published during his/her studies at NEFU shall be placed under surveillance in school or expelled according to the seriousness of their behaviors.

第三十二条涂改、伪造成绩单、签字、印章、推荐信或其他有关学业、学术水平证明者，给予记过处分；情节严重的，给予留校察看处分。

Article 32: Those who obliterate or forge transcript, signature, stamp, recommendation letter or other certificates shall be recorded a demerit. Those who have worse behaviors shall be placed under surveillance at NEFU.

第四章处分程序

Chapter Four: Punishment Procedure

第三十三条学校应及时对留学生违规、违纪事件进行调查并做出处理。具体程序如下：

Article 33: NEFU shall timely investigate and deal with the violation behaviors. Specific procedures are as follows:

（一）给予留学生警告、严重警告、记过处分的，一般由国际交流学院（留学生工作办公室）审批；给予留学生留校察看处分的，由国际交流学院（留学生工作办公室）审核，报主管校领导签批；给予留学生开除学籍处分的，由国际交流学院（留学生工作办公室）审核，提请校长办公会讨论通过。

(I) Warning, serious warning or demerit record shall be reviewed and approved by the School of International Education and Exchanges/ International Student Affairs Office; Disciplinary Probation (Being placed under surveillance at NEFU) shall be reviewed by the School of International Education and Exchanges/ International Student Affairs Office and approved by the Vice President who is in charge; Being expelled shall be reviewed by the School of International Education and Exchanges/ International Student Affairs Office and submitted to be approved by the University Presidents’ Official Meeting.

（二）国际交流学院（留学生工作办公室）协同有关部门对留学生违纪情况进行调查、审核，并提出处理意见；

(II) The School of International Education and Exchanges/ International Student Affairs Office shall cooperate with relevant departments to investigate the violation behaviors.

（三）国际交流学院（留学生工作办公室）出具处分决定书，并送交被处分学生本人；处分决定书内容包括：被处分留学生的基本信息，作出处分的事实和证据，处分的种类、依据和期限，被处分留学生提出申诉的权利和期限等。

(III) The School of International Education and Exchanges/ International Student Affairs Office shall issue punishment decision and send it to the international students to be punished; The content of punishment decision shall include international students’ basic information, facts and evidences for the punishment, punishment type, basis and period of punishment; rights and period for appealling, etc.

留学生应在处分决定书上签字，拒绝签字或因特殊情况不能签字的，由国际交流学院（留学生工作办公室）确定相关证人并记录在案，并在校内公告送达。

International students shall sign to accept the punishment decision. Those who refuse to sign or can’t sign due to special reasons shall be informed by public notice made by School of International Education and Exchanges/ International Student Affairs Office.

（四）对开除学籍处分，在由国际交流学院（留学生工作办公室）提请校长办公会讨论通过后，还须报上级主管部门和受处分留学生所在国驻华使（领）馆备案；

(IV) After the discussion in the Unversity Presidents' Official Meeting, the name of international student who has been expelled should be reported to the superior departments in charge and Embassy by School of International Education and Exchanges/ International Student Affairs Office.

（五）处分决定视情况在一定范围内公告；

(V) Punishment decision shall be announced according to its seriousness.

（六）违纪留学生处分材料归入国际交流学院（留学生工作办公室）文书档案和受处分留学生本人档案。留学生的处分材料包括：违纪留学生的交待及检查材料、主要旁证材料、公安部门或校保卫部门书面材料、处分决定书、留学生处分登记表、处分送达回证和申诉复查结论。

(VI) Punishment materials for international students will be put into the files in the School of International Education and Exchanges/ International Student Affairs Office and international students’ files. The materials include: confession and inspection materials, evidence materials, written material of public security department or security department at NEFU, punishment decision, punishment registration sheet, punishment receiving letters and apealling materials.

第三十四条对违反中国法律、法规受到公安部门或司法部门处罚的留学生的处理，以公安部门或司法部门的处罚决定书为依据。

Article 34: The punishment of the international students who are given by public security department or judicial department due to violating the laws, rules and regulations in China shall be based on the punishment decision made by the public security department or judicial department.

第三十五条留学生如对处分结果有异议，可在接到处分决定书5个工作日内，向学校提出书面申诉。受理申诉的机构为学校学生申诉处理委员会。留学生申诉按《东北林业大学校内申诉管理规定（试行）》处理。

Article 35: If the international student disagrees about the punishment decision, he/she can submit written appealling letters to NEFU Student Appeal Handling Committee within 5 working days after the punishment decision is delivered. Appeals of international student shall be handled according to the Administrative Provisions on Appeal of Northeast Forestry University.

第三十六条凡是受到留校察看以上（含留校察看）纪律处分的留学生，取消下一学年度各种荣誉称号的评选资格，奖学金生中止下一学年奖学金。

Article 36: All international students who are placed under surveillance in school will automatically lose their application qualification for any award next year. The scholarship in the next academic year shall be automatically suspended.

被中止享受奖学金资格者，自下一学年开学起停发其奖学金，本人需按学校有关规定申请自费继续学习。中止期满前，经本人申请，可以参加当年的年度评审，如评审合格，并报有关部门审批通过，可自下一学年起恢复奖学金。

International students whose scholarship is suspended will receive no scholarship from the beginning of next academic year and can apply for self-funded studies. Before the end of the suspension period, international students can apply to participate in the Annual Review. If the result is qualified,their scholarship can be recovered from the next academic year after getting approval from the authorities.

留学生在留校察看期间，可以进行论文答辩，但不授予学位。

During the period of being placed under surveillance at NEFU, international students can make thesis defense but cannot get the degree certificate.

第三十七条凡被给予开除学籍处分的留学生，由学校发给学习证明，并在接到处分决定后10个工作日内办理离校手续离校；对无理取闹、拒不离校者，按校外人员扰乱学校秩序处理。

Article 37: International students who are expelled can only get the studying certificate to them. And they must leave the university within 10 days after getting the punishment notice. Those who make trouble out of nothing and refuse to leave school will enjoy the same treatment as the off-campus people who violate the school orders.

第三十八条警告、严重警告和记过处分的处分期为6个月，留校察看处分的处分期为12个月；处分期满，如受处分留学生各方面表现良好，经留学生本人申请，国际交流学院（留学生工作办公室）审核，可解除其纪律处分。解除处分后，学生获得表彰、奖励及其他权益不再受原处分的影响。

Article 38: Punishment period of warning, serious warning and recording a demerit is 6 months while punishment period of being placed under surveillance at NEFU is 12 months. If international students behave well in all aspects when punishment period expires, the punishment can be relieved after the international students’ application is approved by the School of International Education and Exchanges/ International Student Affairs Office. After the punishment is relieved, the rights for rewarding will be regained.

第三十九条一年内连续两次（含两次）受学院通报批评者，给予警告处分一次；一年内连续两次（含两次）受校纪处分者，或者在留校察看期内再次受校纪处分者，合并给予开除学籍处分；留学生在校学习期间，受到校纪处分累计三次（含三次）以上者，合并给予开除学籍处分。

Article 39: Those who have been reported by the School of International Education and Exchanges/ International Student Affairs Office in the form of notice for 2 continuous times (including 2 times) within one year shall be warned once; those who have been punished by NEFU for 2 continuous times (including 2 times) within one year or punished again during the period of placing under surveillance at NEFU shall be expelled; International students who have been punished for 3 times (including 3 times) accumulatively during their study at NEFU shall be expelled.

第五章附 则

Chapter Five: Supplementary Rules

第四十条对本条例没有列举的违法、违规、违纪行为应给予处分的，可参照本条例中类似条款，视情节轻重及影响程度给予相应的处分。

Article 40: Those behaviors, which violate the laws, rules and regulations but are not included in the provisions, can be punished in the same ways as the similar behaviors according to the seriousness and influence.

第四十一条对非学历教育留学生的纪律处分参照本条例执行。

Article 41: The non-degree international students should also follow the rules and regulations.

第四十二条本条例由国际交流学院（留学生工作办公室）负责解释，自发布之日起施行。

Article 42: The School of International Education and Exchanges/International Student Affairs Office has the final rights of explanation of the rules and regulations in the provisions and the provisions shall be implemented since their issuance.
